RESOLUTION OF INTENT TO SELL OR CONVEY CERTAIN REAL PROPERTY IN WEST DULUTH TO MENARD, INC.

CITY PROPOSAL:
WHEREAS, Section 2-176 of the Duluth City Code, 1959, as amended, requires that prior to any city-owned property being offered for sale or conveyance, the city council shall, by resolution, state its intention to sell or convey such property.
NOW, THEREFORE, BE IT RESOLVED, that the Duluth city council hereby states its intention to offer for sale or conveyance property in the City of Duluth legally described as Lot Eleven (11), Block Fifty-eight (58), ONEOTA.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the conveyance of certain real property to Menard, Inc. While working to clear up the title to its property at the West Duluth location, it was discovered that the City owns a small triangular parcel that is completely enclosed by other parcels owned by Menard, Inc. See Exhibit A attached for a map depicting the property to be sold and Menard, Inc. adjacent property.
The city conducted an internal review of the property and determined that: (a) no building can legally be constructed on it and (b) the property is surplus of the city’s future needs.
The property has an estimated market value of $5,100.
