CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to enter into and execute a three-year lease agreement, substantially in the form attached as Exhibit 1, with Fun Time, LLC, d/b/a Wheel Fun Rentals, for use of the George Hindmand Pilot House in Canal Park to operate its bicycle rental business.  Rent payments shall be deposited to 205-130-1221-4627 (Parks, Community Resources, Park Maintenance, Concessions and Commissions).

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the city to enter into a three-year lease agreement with Fun Time, LLC, d/b/a Wheel Fun Rentals (“Fun Time”), for use of the Pilot House of the vessel George Hindmand (“Pilot House”) to operate its bicycle rental business.  The Pilot House is located in Canal Park on property adjacent to the Marine Museum Parking Lot at the Lakewalk trailhead.

 

Fun Time has previously operated its business in the Pilot House and at another location in Canal Park, but its agreement with the City is currently expired.  The city desires to lease the Pilot House to a private user whose use will complement the development and character of the Canal Park area and generate revenues for the city.  For consideration of the lease agreement, Fun Time will pay Fifteen Thousand Seven Hundred Sixty Dollars and no/100ths ($15,760) or twelve percent (12%) of net receipts, whichever is greater (as defined in the lease agreement).

 

Under the terms of the agreement, either party may terminate the agreement without cause with a 30-day written notice to the other party.  However, the City may not terminate the agreement during the Fun Time’s operating season, which is defined as April 1 through October 31 each year of the agreement.
