CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for public recreational, walkway, and trail purposes, as more particularly described on the Easement Agreement attached as Exhibit 1, from Lake Superior Center Authority, more commonly known as the Great Lakes Aquarium, at no cost to the city, over, upon, across, and along the real property legally described on Exhibit A to Exhibit 1.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes acceptance of a permanent easement from Lake Superior Center Authority, more commonly known as the Great Lakes Aquarium (“Authority”), for public recreational, walking, and trail purposes over property at Bayfront Festival Park, at no cost to the city.

 

In summer 2016, the city constructed a new trail at Bayfront Festival Park that is located on property owned by the Authority.  The Authority is willing to grant an easement to the City for the trail and other public recreational purposes.  A portion of the trail alignment exists on property that the city already has an easement over, so the current easement agreement is for the gap areas only.  Exhibit B to the Easement Agreement attached as Exhibit 1 depicts the easement area granted by the Authority.
