RESOLUTION AUTHORIZING AN AGENCY AGREEMENT BETWEEN THE CITY AND MNDOT FOR FEDERAL PARTICIPATION IN ADVANCE CONSTRUCTION FOR THE WEST SKYLINE PARKWAY STONE MASONRY RETAINING WALL PROJECT.

CITY PROPOSAL:

RESOLVED, that pursuant to Minnesota Statute Section 161.36, the commissioner of transportation may be appointed as agent of the city of Duluth to accept, as its agent, federal aid funds which may be made available for eligible transportation related project.

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute and enter into an agreement with the commissioner of transportation, a copy of which is attached as Exhibit A, prescribing the terms and conditions of said federal aid participation as set forth and contained in Minnesota Department of Transportation Agency Agreement No. 1028476.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the city to enter into an agreement with the Minnesota Department of Transportation to receive federal funds for the West Skyline Parkway stone masonry retaining wall restoration project.  This project is programmed to receive the majority of federal funding in this fiscal year (2017).  However, $400,000 in federal funds will not be available until federal fiscal year 2018, which starts on October 1, 2017.  This agreement clarifies the city’s use of local (municipal state aid funds) for that $400,000 until federal funds are available.  The project is scheduled to start in late summer of 2017 and carry over into the summer of 2018.  MSA funds are available if necessary to bridge the gap in funding; however, this delay in project funding should be a non-issue since funds will be available in October 2017 and the majority of construction will not be done until the summer of 2018.
