RESOLUTION AUTHORIZING AN EIGHTEEN-MONTH LICENSE AGREEMENT WITH COMMUNITY ACTION DULUTH FOR TREE PLANTING NEAR THE WESTERN WATERFRONT TRAIL.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute an eighteen-month license agreement, substantially the same as the agreement attached as Exhibit 1, with Community Action Duluth, for tree planting near the Western Waterfront Trail and surrounding areas, at no cost to the city.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes an eighteen-month license agreement with Community Action Duluth (“CAD”), for tree planting near the Western Waterfront Trail and surrounding areas (“WWFT”), at no cost to the city. The portion of the WWFT subject to the agreement is depicted as Area 1, Area 2, and Area 3 on the attached Exhibit 2.
CAD applied for and received a grant from the U.S. Department of Agriculture, Forest Service, Northeastern Area, State and Private Forestry, related to restoration of native and pollinator friendly tree species and reduction in runoff near shore sites on the St. Louis River Estuary (the “Grant”). The Grant will, among other things, fund the purchasing and planting of trees near the WWFT.
The granting of this license agreement allows CAD, through its Stream Corps Program and in consultation with the City’s Parks Department, to enter and occupy city-owned property to plant trees on designated areas near the WWFT.
