CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute an agreement with Diversion Solutions, LLC, substantially in the form of that attached hereto as Exhibit A, for the administration of driving diversion pilot program for the city of Duluth. Funds generated by the program and collected by Diversion Solutions, LLC, pursuant to the terms of the agreement shall be deposited in Fund 110-110-1104-4644 (general, legislative and executive, attorney and human rights, miscellaneous fees).
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the proper city officials to execute an agreement with Diversion Solutions, LLC, for the administration of the driving diversion pilot program for the city for a two-year period. The driving diversion pilot program was established by Laws of Minnesota 2009, c. 59, art. 3, section 4, and recently extended by the state legislature, 90th Session, HF470, Third Engrossment, Article 3, Sec. 29.
The driving diversion pilot program was created by a law written by criminal prosecutors from Duluth, St. Paul, West St. Paul, South St. Paul and Inver Grove Heights. The program, working through Diversion Solutions, LLC, seeks to assist individuals who have been charged with driving without a valid license to earn back their valid license status through a supervised payment plan, a life skills course, mandatory financial management, and the issuance of a diversion license. Initially established for a two-year period in 2009, the state legislature has twice renewed the program and it is currently set to expire June 30, 2019. Additional cities and counties have also joined the program because of its success.
