Title

RESOLUTION AUTHORIZING A LICENSE AGREEMENT FOR PUBLIC RECREATIONAL TRAIL PURPOSES WITH INDEPENDENT SCHOOL DISTRICT NO. 709 OVER PROPERTY NEAR LINCOLN PARK MIDDLE SCHOOL AT NO COST TO THE CITY.

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute a license agreement, substantially in the form attached as Exhibit 1, with Independent School District No. 709, at no cost to the city, for public recreational trail purposes over the property depicted on the attached Exhibit 2.

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to approve and execute a license agreement between the City and Independent School District No. 709 (“ISD #709”) to allow public use of a portion of ISD #709’s Lincoln Park Middle School property for a multi-use recreational trail.  ISD #709 will be responsible to construct and maintain the trail.  The license agreement remains in effect until terminated by either party upon sixty days’ notice.

The multi-use trail is intended to be a connector to the main spine of Duluth Traverse Trail, a multi-use trail network linking neighborhoods and parks across the entire ridge-line of Duluth from Lester Park in the east to Chambers Grove in the west.
