CITY PROPOSAL:
RESOLVED, that the city council approves settlement of all claims or causes of action in the matter of Ronald Gary Gustafson vs City of Duluth, St. Louis County, and Itasca County, St. Louis County District Court File No. 69-DU-CV-17-848, pursuant to the terms and conditions of a Mediated Settlement Agreement substantially in the form of that attached hereto as Exhibit A.
FURTHER RESOLVED, that the proper city officials are authorized to take all actions necessary to conclude this matter on a full, final, and complete basis; payment of $22,500 to be made from Fund 610-036-1651-5841 (Self Insurance Fund, Insurance Accounts, General City, Liability Claims Expense); said funds represent the city’s portion of the total settlement amount.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes city officials to implement the Mediated Settlement Agreement in Gustafson v. City of Duluth, St. Louis County, and Itasca County, St. Louis County District Court File No. 69-DU-CV-17-848. The City’s portion of the total settlement amount is $22,500. City administration and the city attorney recommend approval of this settlement agreement.
