RESOLUTION APPROVING SETTLEMENT IN THE MATTER OF NORMAN, ET AL. V. CITY OF DULUTH, ET AL. IN THE AMOUNT OF $385,000 PURSUANT TO THE TERMS OF THE MEDIATED SETTLEMENT AGREEMENT.

CITY PROPOSAL:
RESOLVED, that the city council approves settlement of all claims or causes of action against the city and former city employee Gordon Ramsay in the matter of Norman, et al. v. City of Duluth, et al., venue in St. Louis county district court, sixth judicial district, state of Minnesota, pursuant to the terms and conditions of a release and indemnity agreement substantially in the form of that attached hereto as Exhibit A.
FURTHER RESOLVED, that the proper city officials are authorized to take all actions necessary to conclude this matter on a full, final, and complete basis; payment of $385,000 to be made from fund no. 610-036-1651-5841 (self-insurance; insurance accounts; general city; liability claims expense); said funds represent both the city’s and Gordon Ramsay’s portion of the total settlement amount.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes city officials to implement the Mediated Settlement Agreement in this matter. City administration and the city attorney recommend approval of this settlement agreement.
