RESOLUTION OF INTENT FOR CONSTRUCTION OF SANITARY SEWER IN WEST NINTH STREET ALLEY BEGINNING 280 FEET NORTHEAST OF 11TH AVENUE WEST AND EXTENDING TO NORTH TENTH AVENUE WEST, THEN EXTENDING NORTHWEST ON NORTH TENTH AVENUE WEST TO WEST NINTH STREET.

CITY PROPOSAL:

RESOLVED, that pursuant to Section 61 of the City Charter, the city council hereby expresses its intent to cause the construction of public sanitary sewer and services in West Ninth Street Alley beginning 280 feet northeast of North 11th Avenue West and extending to North Tenth Avenue west, then extending northwest on North Tenth Avenue West to West Ninth Street, and hereby requests that the mayor prepare or cause to have prepared plans, specifications and estimates therefor, and file such plans and estimates with the special assessment  board, together with a recommendation as to what portion of the costs should be paid by special assessment, the number of installments in which assessments may be paid, and the properties which should include the special assessment:

                     916 West Ninth Street

                     929 West Ninth Street

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution begins the formal process of making assessable improvements for construction of a sanitary sewer to serve 916 and 929 West Ninth Street.  These properties are currently served by private onsite wastewater treatment systems that have failed.  The extension of the sewer in West Ninth Street Alley and North Tenth Avenue West would benefit those properties, bringing them into compliance with state plumbing code, and would provide a direct connection to the city sewer main.

 

As provided for in Section 61 of the Charter, the process can be initiated by petition or by action of the city council itself.  This case is by petition of the owners of 916 and 929 West Ninth Street.

 

As is normal, the resolution of intent is the first step in the process.  Once approved it will trigger preparation of plans and specifications for the work and estimates of the costs and the assessments involved.  Notices will them be sent to the affected property owners and they will be given the opportunity to be heard before the special assessment board.  After the board makes its recommendations, the matter will return to the city council for consideration of an ordering-in resolution.
