RESOLUTION AMENDING AND CORRECTING THE LEGAL DESCRIPTION FOR THE VACATION AUTHORIZED UNDER RESOLUTION 08-0463.

CITY PROPOSAL:
WHEREAS, the city council of the city of Duluth duly authorized and approved the vacation of certain street and alley public rights-of-way in Resolution No. 08-0463 on July 21, 2008, which resolution purports to affect property legally described as follows:
72nd Avenue East, 73rd Avenue East, 74th Avenue East, 75th Avenue East, 76th Avenue East, Avondale Street, Oakley Street, and all alleys all in Lakeview Manor Division; and Hoover Street east of Chase Avenue in Brighton Gardens First Division.
WHEREAS, Resolution No. 08-0463 was recorded on September 9, 2008, in the Office of the St. Louis County Recorder as Document No. 1090316 and the Office of the St. Louis County Registrar of Titles as Document No. 858300.
WHEREAS, the description of the vacated streets contained in Resolution No. 08-0463 incorrectly referred to Chase Avenue within the plat of Lakeview Manor Division as 76th Avenue East, causing confusion as to precisely which streets were vacated.
NOW, THEREFORE, BE IT RESOLVED, that the legal description for the vacation authorized under Resolution No. 08-0463 is hereby amended and corrected to read as follows:
72nd Avenue East, 73rd Avenue East, 74th Avenue East, 75th Avenue East, Chase Avenue (76th Avenue East), Avondale Street, Oakley Street, and all alleys all within the plat of Lakeview Manor Division; and Hoover Street east of Chase Avenue in the plat of Brighton Gardens First Division.
FURTHER RESOLVED, that the city clerk is, pursuant to Section 100 (b)(7) of the Home Rule Charter of the city of Duluth, 1912, as amended, authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this resolution showing the amended and corrected legal description for the vacation authorized under Resolution No. 08-0463.
