RESOLUTION AUTHORIZING A LICENSE AGREEMENT FOR CLIMBING PURPOSES WITH OLIVER MANAGEMENT SERVICES, INC. AND TROPICANA APARTMENTS LIMITED PARTNERSHIP OVER PROPERTY IN THE KENWOOD NEIGHBORHOOD AT NO COST TO THE CITY.

CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to execute a license agreement, substantially in the form attached as Exhibit 1, with Oliver Management Services, Inc. and Tropicana Apartments Limited Partnership, at no cost to the city, for climbing purposes over the property legally described and depicted on Exhibit A to the attached Exhibit 1.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to approve and execute a license agreement between the City and Oliver Management Services, Inc. and Tropicana Apartments Limited Partnership (“Oliver Properties”) to allow public use of a portion Oliver Properties’ property for the purpose of recreational climbing.  The license agreement remains in effect until terminated by either party upon sixty days’ notice.

 

There is an inactive quarry in the Kenwood neighborhood, near Kenwood Avenue and Partridge Street, that has been used by the general public for years for the purpose of recreational climbing.  Most of the quarry has been open for public use for many years under an easement held by the city. This license agreement allows the public to use the small portion of the quarry area not covered by the existing easement.  The attached Exhibit 2 depicts the entire quarry area in yellow and the area covered by this license agreement in red.
