CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute a license agreement, substantially in the form attached as Exhibit 1, with Oliver Management Services, Inc. and Tropicana Apartments Limited Partnership, at no cost to the city, for public recreational trail purposes over the property legally described and depicted on Exhibits B and C to the attached Exhibit 1.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this resolution is to approve and execute a license agreement between the City and Oliver Management Services, Inc. and Tropicana Apartments Limited Partnership (“Oliver Properties”) to allow public use of a portion Oliver Properties’ property for a multi-use recreational trail. The license agreement remains in effect until terminated by either party upon sixty days’ notice.
This multi-use trail will be used as the main spine of Duluth Traverse Trail, a multi-use trail network linking neighborhoods and parks across the entire ridge-line of Duluth from Lester Park in the east to Chambers Grove in the west. This particular portion lies within the Kenwood neighborhood, near Kenwood Avenue and Partridge Street, and is depicted in blue on the attached Exhibit 2.
