RESOLUTION AUTHORIZING PROPER CITY OFFICIALS TO ACCEPT A DONATION OF REAL PROPERTY FROM DAVID E. RUBLE AND PATRICIA A. RUBLE-KELLEY IN THE EAST HILLSIDE NEIGHBORHOOD.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept the real property described below and enter into the donation agreement, substantially in the form attached as Exhibit 1, with David E. Ruble and Patricia A. Ruble-Kelley a/k/a Patricia A. Ruble, for the donation of real property legally described as follows:

 

Block 59, PORTLAND DIVISION OF DULUTH

 

AND

 

Lots 1, 2, 3 and 4, Block 87, ENDION DIVISION OF DULUTH

 

(the “Property”).

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all documents necessary to effectuate the acquisition of the donated Property from David E. Ruble and Patricia A. Ruble-Kelley a/k/a Patricia A. Ruble and to accept a warranty deed for the Property.

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to only file a certified copy of this resolution and the warranty deed with the St. Louis County Recorder and/or Registrar of Titles to effectuate the conveyance of the Property in the real estate records.

 

Statement of Purpose

STATEMENT OF PURPOSE:  The purpose of this resolution is to authorize and accept the donation of real property located at the intersection of 13th Avenue East and East Third Street (the “Property”).  An aerial view of the Property is outlined in red on the attached Exhibit 2.  The property owners are voluntarily donating the Property.

 

Chester Creek runs through the Property and there is a bridge structure, including a retaining wall, over Chester Creek.  The City has been and will continue to maintain the bridge structure on the Property.
