RESOLUTION AUTHORIZING AN AGREEMENT WITH THE DULUTH SEAWAY PORT AUTHORITY FOR THE INTERMODAL CONTAINER TERMINAL EXPANSION PROJECT.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute an agreement with the Duluth Seaway Port Authority to construct the Intermodal Container Terminal Expansion project at the Clure Public Marine Terminal, said agreement substantially in the form of Attachment 1 attached hereto.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes an agreement with the Duluth Seaway Port Authority under which the parties have established their roles and responsibilities for the expansion project known as the Intermodal Container Terminal Expansion Project (“project”).  The project will be constructed at the Clure Public Marine Terminal which is owned by the Port Authority.  The Port Authority applied for and was awarded a MnDOT Freight Program grant for the project, but the grant has to be received and administered by an entity entitled to receive transportation-related state aid funds.  Under the agreement the city will act as the grant recipient, advertise for bids, let the construction contracts and will oversee the construction management of the project.  No city of Duluth funding will be expended on the project.  As reimbursement for the administration of the project the city will receive 3% of the total construction costs, estimated to be $71,108, plus the MnDOT testing fees estimated at $2,000, as set forth on Exhibit B of the agreement.  The port authority Board of Directors approved entering into the agreement at their February 28, 2018 meeting.
