RESOLUTION AUTHORIZING AN AGENCY AGREEMENT FOR ADVANCE CONSTRUCTION BETWEEN THE CITY OF DULUTH AND MNDOT FOR THE INTERMODAL CONTAINER TERMINAL EXPANSION PROJECT.

CITY PROPOSAL:

RESOLVED, that pursuant to Minnesota Statute Section 161.36, the commissioner of transportation may be appointed as agent of the city of Duluth to accept, as its agent, federal aid funds which may be made available for eligible transportation related projects. 

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute and enter into an agreement with the commissioner of transportation, a copy of which is attached as Exhibit A, prescribing the terms and conditions of said federal aid participation as set forth and contained in Minnesota Department of Transportation Agency Agreement No. 1030542

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes an agreement with the Minnesota Department of Transportation to receive federal funds for the Intermodal Container Terminal Expansion project. 

 

The project will be constructed at the Clure Public Marine Terminal which is owned by the port authority.  The port applied for and was awarded a MnDOT Freight Program grant for the project, but the grant has to be received by an entity entitled to receive transportation-related State Aid funds.  Under the agreement the city shall act as the grant recipient, advertise for bids, let the construction contract and will oversee the construction management of the project.

 

This project is programmed for federal fiscal year 2019, with funds available on October 1, 2018.  If this project is awarded prior to that date and expends funds, the port will reimburse the city of Duluth in accordance with the terms of the port agreement included with the companion resolution 18-0209R.  The city does not have any funding included with the project, city project no. 1717.
