RESOLUTION AUTHORIZING CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES ON SUPERIOR STREET AND FIRST STREET IN CONJUNCTION WITH GREATER DOWNTOWN COUNCIL SIDEWALK DAYS.

 

CITY PROPOSAL:

                     BE IT RESOLVED, that pursuant to Section 8-22(b) of the Duluth City Code, the Duluth City Council hereby authorizes consumption of alcoholic beverages in public places at the following locations in conjunction with Downtown Sidewalk Days, provided that all alcoholic beverages consumed outside of designated serving areas of licensed establishments be consumed only from paper or plastic cups:

 

                                          July 11, 2018, on Lake Avenue to 3rd Avenue West, from 8:00 a.m. to 9:00 p.m.

                                          July 11, 2018, extend closure 3rd Ave East to 3rd Avenue west, Kolar Chevrolet, Buick, GMC, Classic Car Show, from 3:30 p.m. to 9:00 p.m.;

                                          July 12, 2018, on Lake Avenue to 3rd Avenue West, from 8:00 a.m. to 6:00 p.m.; Classic Car Show rain date.

                                          July 13, 2018, First Street blocked / Aces -  from First Avenue West to Second Avenue West, from 6:30 p.m. to midnight.

                                          July 14, 2018, Superior Street Blocked / Dubh Linn - 1st Avenue West to 2nd Ave West, from 5:00 p.m. to midnight.

 

                     BE IT FURTHER RESOLVED, that the dates of this authority may be amended, in the case of inclement weather, if requested in writing by the licensee and approved by the administration.

 

 

STATEMENT OF PURPOSE:   This resolution waives the drinking in public prohibition for the community events sponsored by the Greater Downtown Council.  Such waiver for special events is authorized by Section 8-22(b) of the City Code and is requested by the police department after consultation with the Greater Downtown Council to eliminate the law enforcement problem of having to take action against persons wandering beyond the designated service areas with drinks.  For safety purposes, all alcoholic beverages consumed in these areas will have to be in paper cups.
