RESOLUTION ACCEPTING A TEMPORARY EASEMENT FOR CONSTRUCTION PURPOSES AND A PERMANENT EASEMENT FOR ROAD AND UTILITY PURPOSES IN DEVONSHIRE STREET ALLEY FROM KEITH M. AUBOL.

 

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept a temporary easement for construction purposes as described in the easement agreement attached as Attachment 1 from Keith M. Aubol, Grantor, over that portion of Lot 1, Block 9, Bryant Addition to Duluth Second Division, described below:

 

The South 5 feet of Lot 1, Block 9, Bryant Addition to Duluth Second Division, as depicted on Exhibit A.

 

Said easement shall terminate no later than July 1, 2018.

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for road and utility purposes as described in Attachment 1 over that portion of the easterly 25 feet of the southerly 141 feet of the south half of the southwest quarter of the northeast quarter of the northwest quarter of Section 5, Township 49, Range 14 west, of the fourth principal meridian, described below:

 

The easterly 25.00 feet of the southerly 20.00 feet of the south half of the southwest quarter of the northeast quarter of the northwest quarter of Section 5, Township 49, Range 14 west of the fourth principal meridian, as depicted on Exhibit A.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes acceptance of a temporary construction easement and a permanent street and utility easement in conjunction with the acquisition and improvement of the Devonshire Street Alley easement.
