RESOLUTION ACCEPTING PERMANENT EASEMENT FOR A PEDESTRIAN WALKING PATH FROM JANET E. BLATNIK OVER PROPERTY LOCATED IN THE LAKESIDE NEIGHBORHOOD AT NO COST TO THE CITY.

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for the construction, maintenance, inspection, operation, protection, repair, replacement, and/or removal of a pedestrian walking path, as more particularly described on the Easement Agreement attached as Exhibit 1, from Janet E. Blatnik, at no cost to the city, over the real property depicted on Exhibit A to Exhibit 1 and legally described on Exhibit B to Exhibit 1. 

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes acceptance of a permanent easement from Janet E. Blatnik for the construction, maintenance, inspection, operation, protection, repair, replacement, and/or removal of a pedestrian walking path on Norwood Street near 45th Avenue East, at no cost to the city.  The easement area is depicted on Exhibit A to the attached Exhibit 1 and legally described on Exhibit B to the attached Exhibit 1.

 

Through Resolution No. 16-0644, the City agreed to vacate a 20-foot wide alley between Blocks 3 and 4 of the recorded plat of “Lakeside Gardens” contingent upon the property owner granting a pedestrian easement on property adjacent to the vacated alley.  This resolution accepts the easement agreement required as a condition to the vacation authorized under Resolution No. 16-0644.
