RESOLUTION AUTHORIZING AN AMENDMENT TO A JOINT POWERS AGREEMENT WITH THE MINNESOTA POLLUTION CONTROL AGENCY ACCEPTING A GRANT IN AN AMOUNT NO LESS THAN $2,155,660 TO FUND A PORTION OF THE COST OF THE MINNESOTA SLIP SEAWALL REPAIR AND CLEANUP PROJECT.

 

Body

CITY PROPOSAL:

                     WHEREAS, Resolution No. 17-0805 authorized the proper city officials to: (a) enter into a joint powers agreement (JPA) with the Minnesota Pollution Control Agency (MPCA) for repair of the seawall in the Minnesota Slip adjacent to Harbor Drive and cleanup of the Minnesota Slip and (b) accept a grant from the MPCA to pay for a portion of the costs in an amount no less than $2,155,66.

                     WHEREAS, the city and MPCA entered into the JPA authorized under Resolution No. 17-0805 on or about January 10, 2018; and

                     WHEREAS, the city and MPCA desire to amend the JPA to: (a) extend the expiration date from September 30, 2018 to September 30, 2019 and (b) amend Attachments A, B, and C to the JPA to specify that the William A. Irvin ship will be returned to the Minnesota Slip upon completion of the project.

NOW, THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to execute an amendment to a joint powers agreement, city contract no. 23381, substantially in the form attached as Exhibit 1, with the MPCA related to the seawall repair project in the Minnesota Slip.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes an amendment to a joint powers agreement, city contract no. 23381, with the Minnesota Pollution Control Agency related to the seawall repair project in the Minnesota Slip.  The changes to the joint powers agreement and revised attachments are shown in the amendment as stricken for deletions and underlined for insertions. The principal changes are to require the return of the William A. Irvin to Minnesota Slip following completion of the project and extend the expiration date of the agreement to September 30, 2019.
