CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute a five-year license agreement, substantially in the form attached as Exhibit 1, with the Lake Superior Center Authority for use of property for adjacent to Bayfront Festival Park for park, recreation, and other related purposes, at no cost to the city.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes a five-year license agreement with the Lake Superior Center Authority (LSCA) for use of property adjacent to Bayfront Festival Park for park, recreation, and other related purposes, at no cost to the city.  The property subject to this agreement is depicted in red on Exhibit A attached to Exhibit 1.

 

LSCA owns certain property adjacent to Bayfront Festival Park, and had granted easements to the City for trail and other recreational purposes over such property under separate agreements.  There is a small portion of property owned by LSCA for which there is no current agreement or easement to permit use by the City or public, and this agreement provides for such use.

 

Under the terms of the agreement, the City is responsible for all costs associated with the use and maintenance of the property.  The agreement provides that the City can enter into agreements with third parties for the use of the property for purposes consistent with the use of Bayfront Festival Park.  The agreement will expire on December 31, 2023.
