CITY PROPOSAL:
WHEREAS, on April 24, 1989, the Duluth city council adopted Resolution 89-0323, which resolution was amended by Resolution 89-0323, Resolution 98-0949, Resolution 99-0239, Resolution 02-0606, Resolution 04-0202, Resolution 04-0215, Resolution 09-0342 and Resolution 10-0229 (collectively, the "DEDA establishment resolution"); and
WHEREAS, the council desires to further amend the DEDA establishment resolution as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED, that the DEDA establishment resolution is hereby amended by the addition of new Paragraphs 20 and 21 thereof which shall read as follows:
20. That the city council will not approve an expenditure of funds by DEDA requiring the council's approval thereof which constitutes a "Business Subsidy" as defined by Minnesota Statutes Section 116J.993 Subd. 3 unless DEDA shall have adopted Business Subsidy Criteria at least as restrictive as those adopted by the city of Duluth and the granting of such subsidy is in conformance with those Business Subsidy Criteria.
21. That all DEDA agreements providing assistance to any project as defined in Section 2-25 of the Duluth City Code, 1959, as amended, shall include imposition of the requirements of Section 2-25, 2-26, 2-27, 2-28 and 2-29 of the Code upon the granting of such subsidy.

STATEMENT OF PURPOSE: The purpose of this resolution is to amend the resolution which established and governs the Duluth Economic Development Authority ("DEDA") to make the provisions of Chapter 2 pertaining to the use of PLAs and the City's wages and hours requirements applicable to DEDA agreements.
