RESOLUTION AUTHORIZING A LICENSE AGREEMENT FOR PUBLIC RECREATIONAL TRAIL PURPOSES WITH ULLAND BROTHERS, INC. OVER PROPERTY ADJACENT TO THE MAGNEY-SNIVELY NATURAL AREA AT NO COST TO THE CITY.

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute a license agreement, substantially in the form attached as Exhibit 1, with Ulland Brothers, Inc., at no cost to the city, for public recreational trail purposes for the hiking and multi-use trails depicted on Exhibit B to the attached Exhibit 1.

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize a license agreement between the City and Ulland Brothers, Inc. (“Ulland Brothers”) to allow for public use of a portion Ulland Brother’s property for hiking and multi-use recreational trails.  The license agreement remains in effect until May 31, 2023 and provides for automatic renewal of successive five-year terms.

The multi-use trails depicted on Exhibit B to the attached Exhibit 1 will be used as part of the Duluth Traverse Trail, a multi-use trail network linking neighborhoods and parks across the entire ridge-line of Duluth from Lester Park in the east to Chambers Grove in the west.  The hiking trails depicted on Exhibit B to the attached Exhibit 1 will be used as a part of the Superior Hiking Trail, a 310-mile long natural surface footpath from Duluth to the Canadian border.

Ulland Brother’s property is adjacent to the Magney-Snively Natural Area and existing trails.
