CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to enter into and execute an amended and restated agreement, substantially in the form attached as Exhibit 1, with Spirit Mountain Recreation Area Authority, for construction of an all-weather biking trail. City shall be responsible to pay for the materials and equipment rental in connection with the project in an amount not to exceed $146,200; payments to be made from Fund 452-030-5530-HANDHTAX-1518. 

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the city of Duluth (“City”) to enter into an amended and restated agreement with Spirit Mountain Recreation Area Authority (“Authority”) for construction of an all-weather biking trail in the Spirt Mountain Recreation Area.  An all-weather biking trail uses a variety of techniques during construction to help prevent damage in wet conditions without negatively affecting the trails when dry.  Construction of the all-weather trail is essential to further establish Duluth as a nationally significant mountain biking destination and competition site as both visitors and race organizers need guarantees that there will be rideable terrain regardless of weather.

 

Under the terms of the agreement, the City will be responsible to rent all necessary equipment and order and pay for all materials needed to complete the project, in an amount not to exceed $146,200.  The Authority will be responsible for matching the City’s contribution, which match will largely come in the form of labor costs to construct the trail using defined techniques.  The Authority will also be responsible to obtain and pay for all applicable permits, install wayfinding for the trail, provide GIS information for the trail, and pay for all project costs above the City’s contribution. 

 

The original agreement for the all-weather biking trail was approved and authorized under Resolution No. 17-0569 and included funding for Phase I.  The parties wish to amend and restate the agreement to include both Phase I and Phase II of the all-weather biking trail.  The City has already contributed its portion of the costs for Phase I in the amount of $72,000.

 

The proposed trail alignment for Phase I is depicted in pink on the attached Exhibit 2.  The proposed trail alignment for Phase II is depicted in blue on the attached Exhibit 2.  An estimated budget for Phase I of the project is shown on the attached Exhibit 3, and the estimated budget for Phase II of the project is shown on the attached Exhibit 4.
