CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to enter into and execute an amended and restated agreement, substantially in the form attached as Exhibit 1, with Park Hill Cemetery Association for utilization of existing and future multi-use and hiking trails for a twenty-five year period, at no cost to the city.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the city of Duluth (“City”) to enter into an amended and restated agreement with Park Hill Cemetery Association for utilization of existing and future multi-use and hiking trails for the period November 1, 2015 through October 31, 2040, at no cost to the city.  The City previously entered into a license agreement with Park Hill for the same purpose, however, some of the proposed trail alignments were not constructed and the City desires to build alternative routes.  The trail alignments for the multi-use and hiking trails are shown on Exhibit A to Exhibit 1.

 

The multi-use trails will be a part of the trail system known as the “Duluth Traverse Trail,” and the hiking trails will be a part of the trail system known as the “Superior Hiking Trail.”

 

Under the terms of the amended and restated agreement, the City is responsible to construct and maintain the trails and related improvements, e.g., signage.
