RESOLUTION ACCEPTING PERMANENT EASEMENT FOR UTILITY PURPOSES FROM THE STATE OF MINNESOTA OVER TAX-FORFEITED PROPERTY ACROSS FROM THE GRAND AVENUE CHALET WITHIN THE SPIRIT MOUNTAIN RECREATION AREA FOR $196.

Body

CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for utility purposes, as more particularly described on the Easement attached as Exhibit 1, from the State of Minnesota, for $196, over the real property legally described on Exhibit A to Exhibit 1 and depicted on Exhibit B to Exhibit 1; payment to be made from Fund No. 510-500-1930-2330-5414 (Water, Public Works and Utilities, Engineering, Utility Engineering, Software Licenses and Maintenance Agreements).

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement for utility purposes from the State of Minnesota, for $196, over tax-forfeited property across from the Grand Avenue Chalet within the Spirit Mountain Recreation Area.

In 2015, the City constructed a water line from the St. Louis River Estuary up to Spirit Mountain.  The water line runs from the Estuary adjacent to Tallus Island, crosses over and through real property owned by the State of Minnesota (as well as through property owned by other entities for which the city already has easements, permits, or similar agreements for), and continues up the hill to Spirit Mountain where it provides water for snowmaking operations.
