RESOLUTION AUTHORIZING THE PURCHASE OF REAL PROPERTY ADJACENT TO HARTLEY PARK FROM INDEPENDENT SCHOOL DISTRICT NO. 709 IN THE AMOUNT OF $390,250, PLUS CLOSING COSTS IN AN AMOUNT UP TO $6,000, FOR A TOTAL AMOUNT NOT TO EXCEED $396,250.

CITY PROPOSAL:

                     RESOLVED, that the proper city officials are hereby authorized to enter into the purchase agreement, substantially the same as that on file in the office of the City Clerk, with Independent School District No. 709, authorizing the purchase of a real property, consisting of approximately 23 acres, and legally described as:

 

Lots One (1) through Ten (10), both inclusive, Block Four (4);

Lots One (1) through Six (6), both inclusive, Block Five (5);

All of Block Six (6);

Lots Thirteen (13) through Twenty-one (21), both inclusive, Block Seven (7);

Lots One (1) through Eight (8), both inclusive, Block Eight (8);

All of Block Nine (9);

together with all vacated streets and avenues appurtenant thereto, all in HARTLEY HILLS FOURTH ADDITION, St. Louis County, Minnesota.

 

EXCEPT all minerals.

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to disburse three hundred ninety thousand two hundred and fifty dollars ($390,250) for the purchase price of the above-described real property, plus an additional amount up to $6,000 for closing costs in connection with the transaction, payable from Fund 205-130-1220-5510-CM205-HARTLEY-ISD709 (Parks, Community Resources, Parks Capital, Land, Project - CM205-HARTLEY-ISD709).

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to execute all documents necessary to effectuate the acquisition of the real property from Independent School District No. 709.

 

FURTHER RESOLVED, that the proper city officials are hereby authorized to file a certified copy of this resolution authorizing the purchase of the above-described property with the St. Louis County Recorder and/or Registrar of Titles, together with the deed from Independent School District No. 709.  The proper city officials shall not file a copy of the purchase agreement, substantially the same as that on file in the office of the City Clerk, with the St. Louis County Recorder and/or Registrar of Titles.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this resolution is to authorize the purchase of the above-described real property, approximately 23 acres in size, from Independent School District No. 709, to be added to Hartley Park.  The purchase price for the property is $390,250, plus an additional amount up to $6,000 for associated closing costs including but not limited to the title examination fee, title insurance premium, deed tax, and recording fees.  An aerial view of the property to be purchased is attached as Exhibit 2. 

 

 

The acquisition and future restoration of this property will protect a cold water trout stream, preserve recreational connectivity to Hartley Park from the Pleasantville neighborhood, and preserve a buffer between future development and Hartley Nature Center’s primary programming area.

 

The city accepted a grant from the state of Minnesota under Resolution 18-0126, as amended by Resolution 18-0308, that funds the purchase of this property.
