RESOLUTION AUTHORIZING A COOPERATIVE AGREEMENT WITH THE STATE OF MINNESOTA TO CROSS THE WILLARD MUNGER STATE TRAIL.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into and execute a cooperative agreement, substantially in the form attached as Exhibit 1, with State of Minnesota, acting by and through the Commissioner of the Department of Natural Resources to cross a portion of the William Munger State Trail to construct, use, and maintain a public road to be known as “Kayak Bay Drive.”
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the city of Duluth (“City”) to enter into a cooperation agreement with with State of Minnesota, acting by and through the Commissioner of the Department of Natural Resources to cross a portion of the William Munger State Trail to construct, use, and maintain a public road to be known as “Kayak Bay Drive.” Under the terms of the agreement, the City agrees to construct trail crossings at Pulaski Street, Riverside Drive, and soon-to-be-built Kayak Bay Road.
The city council previously authorized the City to apply for an easement from the State of Minnesota for the road crossing under Resolution No. 18-0168. This cooperation agreement is separate, but in addition to, the easement agreement.
