AN ORDINANCE AMENDING ORDINANCE 9127 DESIGNATING THE OLD CENTRAL HIGH SCHOOL BUILDING A HERITAGE PRESERVATION LANDMARK.

CITY PROPOSAL:
The city of Duluth does ordain:

Section 1. That Section 1 of Ordinance 9127, recorded on April 13, 1993 in the Office of the St. Louis County Registrar of Titles as Document No. 562894 and in the Office of the St. Louis County Recorder as Document No. 571167, is hereby amended to read as follows:

Section 1. That the city of Duluth does designate, pursuant to Chapter 28A of the Duluth City Code, 1959, as amended, the Old Central High School building as a Duluth heritage preservation landmark; said landmark is the exterior of the building located on the following described property:
Lots 1, 3, 5, 7, 9, 11, 13, and 15, DULUTH PROPER, FIRST DIVISION, EAST SECOND STREET;
AND
Lots 2, 4, 6, 8, 10, 12, 14, and 16, DULUTH PROPER, FIRST DIVISION, EAST THIRD STREET.

Section 2. That the following described real property is released from any and all designations and/or encumbrances created in Ordinance 9127:
Lots 2, 4, 6, 8, 10, 12, 14, and 16, DULUTH PROPER, FIRST DIVISION, EAST SECOND STREET.
Section 3. That this ordinance shall take effect 30 days after its passage and publication.

Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this ordinance is to correct the legal description of the Old Central High School building, which was designated as a Duluth heritage preservation landmark in Ordinance 9127, passed by the Duluth city council on February 22, 1993, with an effective date of April 11, 1993. The original legal description contained in Ordinance 9127 inadvertently included eight lots across the street from the Old Central High School Building and did not properly designate eight other lots as a Duluth heritage preservation landmark.
