RESOLUTION DEDICATING TWO EASEMENTS FOR UTILITY PURPOSES ON PROPERTY NEAR AIRPORT ROAD AND VACATED VANDENBERG DRIVE.

CITY PROPOSAL:
RESOLVED, that the city of Duluth does hereby dedicate to the general public a utility easement over city-owned property in St. Louis County, Minnesota legally described and depicted on the attached Exhibit A.
FURTHER RESOLVED, that the city of Duluth does hereby dedicate to the general public a utility easement over city-owned property in St. Louis County, Minnesota legally described and depicted on the attached Exhibit B.
FURTHER RESOLVED, that the proper city officials are authorized to record with the St. Louis County Recorder and/or Registrar of Titles of St. Louis County, Minnesota, a certified copy of this resolution effectuating the dedications granted under this resolution.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution dedicates to the general public utility easements over city-owned property near Airport Road and vacated Vandenberg Drive. This property is part of Duluth Airport property, and the Duluth Airport Authority (“DAA”) is in support of the easement dedications.
Resolution 18-0723, passed on October 22, 2018, vacated certain rights of ways within the plat of Airport Division. The City and the DAA commenced the vacation process to support the construction of a new structure. During the vacation process, city staff determined that existing utilities needed to be relocated, so this resolution formally dedicates the new utility areas as easements in favor of the public.
