CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept a permanent utility easement, as more particularly described on the Easement Agreement attached as Exhibit 1, from First Lutheran Church of Duluth, Minnesota, at no cost to the city, over the real property legally described and depicted within Exhibit 1.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent utility easement from First Lutheran Church of Duluth, Minnesota, at no cost to the city, over property near Superior Street and 10th Avenue East. 

 

The Duluth Running Co. is adjacent to First Lutheran Church’s property and desires to connect to city gas.  The building owned by Duluth Running Co. runs up to its property line, so there is not room for the city to install the pipe on Duluth Running Co.’s property.  With the granting of this easement, the pipe servicing the gas for Duluth Running Co. will be installed on First Lutheran Church’s property.
