CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement and right of way for road or trail purposes, as more particularly described on the Easement Agreement attached as Exhibit 1, from the State of Minnesota, for $13,615.20, over the real property legally described and depicted on Exhibit A to Exhibit 1; payable from Fund 452-030-5530-HANDHTAX-1507 (Tourism and Recreational Project, Finance, Improvements Other Than Buildings, Half and Half Tax Projects - Water Access).

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement and right of way from the State of Minnesota, by and through its Commission of Natural Resources, over and across a portion of the Munger Trail for $13,615.20.

 

Resolution No. 18-0168 authorized the city to apply for this easement in connection with the creation of a new road from Grand Avenue to Tallus Island, which will be called “Riverwest Road.”  Resolution No. 18-0670 authorized the city to enter into a cooperative agreement with the State of Minnesota, Department of Natural Resources, to formalize the terms and conditions under which the DNR would grant this easement.  The purpose of this resolution is to formally accept the easement granted by the State of Minnesota and define the exact easement area.
