CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from Washington Realty LLC, a permanent easement for street and utility purposes over, under, and across the lands described and depicted on Exhibit A to the attached Exhibit 1, at no cost to the City.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement for street and utility purposes from Washington Realty LLC over, under, and across property located at the intersection of Railroad Street and Garfield Avenue, at no cost to the City. 

 

The City recently conducted an audit of its real estate interests in Garfield Avenue and Railroad Street and found that an easement over the same area granted in 1981 by a predecessor in interest in Washington Realty LLC’s property contained a legal description that is open to interpretation.  The acceptance and filing of this new easement ensures that the City has proper rights for the existing road and utilities in the easement area.
