RESOLUTION APPROVING AN AGREEMENT WITH KELLER LENKNER LLC, CONSOVOY MCCARTHY PARK PLLC, AND HOFF BARRY, P.A. FOR LEGAL SERVICES REPRESENTING THE CITY IN REGARD TO FEDERAL MULITDISTRICT LITIGATION INVOLVING POTENTIAL VIOLATIONS OF LAW IN THE MARKETING, SALE, AND DISTRIBUTION OF OPIOIDS.

CITY PROPOSAL:
RESOLVED that the proper city officials are hereby authorized to execute an agreement, substantially the same as that attached hereto as Exhibit A, with Keller Lenkner LLC, Consovoy McCarthy Park PLLC, and Hoff Barry, P.A. under which the firms will represent the city in regard to federal multidistrict litigation involving potential violations of law in the marketing, sale and distribution of opioids by numerous pharmaceutical companies. Attorneys’ fees and expenses will be paid from any funds recovered on behalf the city on a one-third contingency basis, payable from fund no. 610-036-1651-5304 (self-insurance fund, insurance accounts, general city, legal services).
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the proper city officials to execute an agreement with Keller Lenkner LLC, Consovoy McCarthy Park PLLC, and Hoff Barry, P.A. under which the firms will represent the city in regard to federal multidistrict litigation involving the potential violations of law in the marketing, sale and distribution of opioids and the resulting economic harm to the City of Duluth.
