CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to accept a permanent easement for public recreational, walkway, and trail purposes, substantially the same as the easement agreement attached as Exhibit 1, from Verso Minnesota Wisconsin LLC, at no cost to the city, under, over, across and along real property legally described on Exhibit A to Exhibit 1.
The easement intended to be granted is more clearly shown on Exhibit B attached to Exhibit 1.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes acceptance of a permanent trail easement from Verso Minnesota Wisconsin LLC over property near the intersection of Main Street and North Fifty-Sixth Avenue West together with portions of vacated Polk Street. An aerial view of the easement area is attached as Exhibit A. This easement will allow the City to construct a portion of the Cross City Trail (CCT) across property owned by Verso. The parties agree that the City will construct and maintain continuous fencing along both the southerly and northerly lengths of the Northerly Easement Area as depicted in Exhibit B. The parties also agree that the City will construct and maintain security fencing around the parking area as depicted in Exhibit C.
