RESOLUTION AUTHORIZING A LICENSE AGREEMENT BETWEEN THE CITY OF DULUTH AND THE LAKE SUPERIOR AND MISSISSIPPI RAILROAD.

CITY PROPOSAL:
WHEREAS, the city of Duluth (City) wishes to grant the Lake Superior and Mississippi Railroad (LSMR) a non-exclusive license at no cost to allow LSMR the ability to provide scenic train excursions along the city owned rail track from Munger Landing to Boy Scout Landing.
NOW, THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to enter into a License agreement with LSMR, substantially in the form attached hereto as Exhibit 1, for the continued use of city-owned railroad trackage through December 31, 2023.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a License agreement with the Lake Superior and Mississippi Railroad (LSMR) to: (a) define the track portions and conditions allowed for passenger use, (b) describe maintenance and safety expectations.
