RESOLUTION AUTHORIZING A TEMPORARY CONSTRUCTION ACCESS AGREEMENT WITH ULLAND BROTHERS, INC.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into an agreement, attached hereto as Exhibit A, with Ulland Brothers, Inc., for a temporary construction access, at no cost to the city, with the temporary access to expire November 1, 2019 for the location depicted in Exhibit B.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes the city to execute a temporary construction and access easement with Ulland Brothers, Inc. This agreement is necessary to complete city and partner led restoration projects at Sargent Creek. Ulland Brothers, Inc. property will be used to access the project site and stage construction materials and equipment.
South St. Louis Soil and Water Conservation District (SWCD) wishes to undertake, at no cost to the City, a flood recovery project for the portion of Sargent Creek that crosses City owned property in order to create a stable stream channel and repair certain damage that occurred as a result of the 2012 flood. SWCD will complete restoration work in 2019.
Creek Restoration by SWCD complements the City of Duluth’s grant funded project to restore and stabilize Sargent Creek Bridge and provide safe passage over Sargent Creek via the DWP Trail. The project will replace the existing bridge deck with low maintenance, pedestrian friendly surface, address structural deterioration on the west abutment as well as address ongoing erosion issues underneath the existing structure. The existing deck will be removed and replaced and a cable railing system will be installed for user safety and to provide unobstructed views of the St. Louis River Estuary. Restoration is expected to commence in 2019.
