RESOLUTION IN THE MATTER OF THE ON SALE INTOXICATING LIQUOR LICENSE OF JOEL’S LLC D/B/A MEXICO LINDO, 600 EAST SUPERIOR STREET, SUITE 201, DULUTH, MINNESOTA 55802.

CITY PROPOSAL:
BE IT RESOVED, that the City Council makes the following findings of fact:
(a) On September 4, 2019, the City of Duluth Alcohol, Gambling and Tobacco Commission held a public hearing to consider whether disciplinary action should be taken against the intoxicating liquor license of Joel’s LLC d/b/a Mexico Lindo, 600 East Superior Street Suite #201, Duluth, Minnesota 55802.
(b) The Notice of Hearing is attached hereto as attachment A.
(c) The Commission has submitted its Report to City Council attached hereto as attachment B.
(d) Pursuant to the Duluth City Code Chapter 8, Section 9 (a), on September 23, 2019, the city council considered the records and evidence submitted;
(e) The finding of facts as set forth in attachment B regarding any suspension, revocation and /or civil penalty relating to the on-sale intoxicating liquor license of Joel’s LLC d/b/a Mexico Lindo are adopted.
FURTHER RESOLVED, that the decision of the City Council regarding any suspension, revocation and/or civil penalty is as follows: the City Council hereby adopts the recommended penalty of the Alcohol Gambling & Tobacco Commission and imposes a $500 fine payable to the City Clerk’s Office within 30 days of final approval of this resolution.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution establishes the Duluth City Council’s decision in the disciplinary matter of the on sale intoxicating liquor license of Mexico Lindo pursuant to Duluth City Code Section 8-9. The City of Duluth Alcohol, Gambling and Tobacco Commission reviewed this matter on September 4, 2019 and recommends the City Council impose a $500 penalty.
