CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to accept, substantially in the form attached as Exhibit 1, from Hillside Rentals, LLC, a permanent easement for street and utility purposes over, under, and across the lands legally described on the attached Exhibit 1, at no cost to the City.

 

Statement of Purpose

STATEMENT OF PURPOSE:  This resolution authorizes the acceptance of a permanent easement for street and utility purposes from Hillside Rentals, LLC over, under, and across property located near First Avenue West between Third Street and Fourth Street, at no cost to the City. 

 

Over fifty years ago, the City vacated half of the platted alley lying between Third Street and Fourth Street between First Avenue West and Second Avenue West.  However, the alley continues to be used by the public for vehicular, pedestrian, and utility purposes, and the City maintains the alley as a city street.  The acceptance of this easement formalizes the existing public use of the alley for right-of-way and utility purposes.
