RESOLUTION AUTHORIZING A FIRST AMENDMENT TO A NON-EXCLUSIVE USE AGREEMENT WITH THE COLLEGE OF ST. SCHOLASTICA, INC. FOR USE OF WADE STADIUM.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to enter into a first amendment to a non-exclusive use agreement, substantially in the form attached as Exhibit 1, with the College of St. Scholastica, Inc. for use of Wade Stadium for its college interscholastic baseball program. Payments received under this agreement shall be deposited into the Special League Fund 210, Agency 030, Organization 3190, Revenue Source 4625-04.
Statement of Purpose
STATEMENT OF PURPOSE: This resolution authorizes a first amendment to an agreement with the College of St. Scholastica, Inc. (“CSS”) for non-exclusive use of Wade Stadium for its college interscholastic baseball program to: (1) allow for significant improvements to the visiting team clubhouse and (2) extend the term until December 31, 2028 and provide for additional renewal five-year periods.
CSS desires to invest at least $170,000 toward the redevelopment of the visiting team clubhouse inside of Wade Stadium consistent with the plans and specifications attached to the first amendment. CSS uses Wade Stadium as the home stadium for its baseball program, and will exclusively use the visiting team clubhouse as the locker room for its players.
Except as specifically amended by the first amendment attached as Exhibit 1, the provisions of the Use Agreement shall continue to govern the terms of CSS’s use of Wade Stadium.
