AN ORDINANCE AMENDING ORDINANCE 9417 DESIGNATING THE FORMER LESTER PARK BRANCH LIBRARY AS A DULUTH HERITAGE PRESERVATION LANDMARK.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That Section 1 of Ordinance 9417, recorded on September 7, 1999 in the Office of the St. Louis County Recorder as Document No. 762614, is hereby amended to read as follows:
Section 1. That the city of Duluth does designate, pursuant to Chapter 28A of the Duluth City Code, 1959, as amended, the Lester Park Branch Library as a Duluth heritage preservation landmark; said is described as follows:
Lot 1, Block 14, LESTER PARK 2ND DIVISION,
St. Louis County, Minnesota.
Section 2. That the following described real property is released from any and all designations and/or encumbrances created in Ordinance 9417:
Lot 2, Block 14, LESTER PARK 2ND DIVISION,
St. Louis County, Minnesota.
Section 3. That this ordinance shall take effect 30 days after its passage and publication.
Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this ordinance is to correct the legal description of the former Lester Park Branch Library, which was designated as a Duluth heritage preservation landmark in Ordinance 9417, passed by the Duluth city council on July 26, 1999, with an effective date of September 5, 1999. The original legal description contained in Ordinance 9417 inadvertently included a vacant lot adjacent to the former Lester Park Branch Library.
The map attached as Exhibit A shows the former Lester Park Branch Library lot that will continue to remain designated as a Duluth heritage preservation landmark in red, as well as the vacant lot released from Ordinance 9417 in blue. Attached as Exhibit B is the Site Plan attached to the Staff Report included in Ordinance 9417, which outlines only the former Lester Park Branch Library lot and not the adjacent, vacant lot.
