AN ORDINANCE DEDICATING A PERPETUAL EASEMENT FOR STREET AND UTILITY PURPOSES OVER CITY-OWNED PROPERTY.

CITY PROPOSAL:

The city of Duluth does ordain:

                     Section 1.

                     (a)                     That the city of Duluth does hereby dedicate to the general public a perpetual easement for street and utility purposes over, under and across the property legally described on the attached Exhibit A.

                     Section 2.  That the proper city officials are authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this ordinance showing the easement to be dedicated. 

                     Section 3.  That this ordinance shall take effect 30 days after its passage and publication.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the dedication of a perpetual easement for street and utility purposes across city-owned property in the Lincoln Park neighborhood.  The dedication of this easement allows for the continued operation, maintenance, repair, replacement, or removal of the existing street known as Lower Michigan Street.

 

Although Lower Michigan Street has been used as a road for a number of years, it has never been formally dedicated to the public.  In connection with the State of Minnesota, Department of Transportation’s upcoming Twin Ports Interchange project, it needs to take over Lower Michigan Street as an alternative to I-35.  In order to do so, the road must be dedicated to the public and the easement filed in the St. Louis County real estate records.

 

Attached as Exhibit B are maps depicting an aerial view of the property to be dedicated (as shown in red).
