CITY PROPOSAL:
WHEREAS, on or about January 1, 2010, the city of Duluth ("City") entered into an agreement with the County of St. Louis ("County") for the use of real property near the Public Safety Campus for the storage of impounded vehicles ("Impound Lot") (the "2010 Lease Agreement");
WHEREAS, on or about February 21, 2017, the City entered into a First Amendment to Lease Agreement (the "First Amendment") to provide for the back payment of unpaid storm water charges, authorize an increase in annual rent, and update the parties contact information. The 2010 Lease Agreement and First Amendment are collectively referred to as the "Lease Agreement;" and
WHEREAS, the parties desire to further amend the Lease Agreement to extend the term through December 31, 2020.
NOW, THEREFORE, BE IT RESOLVED, that the proper city officials are hereby authorized to execute a second amendment to the Lease Agreement, substantially the same as the agreement attached as Exhibit 1, with the County of St. Louis, for the use of real property near the public safety campus for the storage of impounded vehicles.
FURTHER RESOLVED, that the annual rent, in the amount of $3,724.00, for use of the Impound Lot shall be paid from Fund No. 110-160-1610-5460 (General Fund, Police, Admin & Investigation, Law Enforcement Operating Expenses).

STATEMENT OF PURPOSE: This resolution authorizes a second amendment to the lease agreement with St. Louis County ("County") for use of real property near the public safety campus for the storage of impounded vehicles ("Impound Lot").
