AN ORDINANCE DEDICATING A PERPETUAL EASEMENT FOR STREET PURPOSES OVER CITY-OWNED PROPERTY.

CITY PROPOSAL:

The city of Duluth does ordain:

                     Section 1.

                     (a)                     That the city of Duluth does hereby dedicate to the general public a perpetual easement for street purposes over, under and across the property legally described on the attached Exhibit A and B; the property described on Exhibit B is depicted on the attached Exhibit C.

                     Section 2.  That the proper city officials are authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this ordinance showing the easement to be dedicated. 

                     Section 3.  That this ordinance shall take effect 30 days after its passage and publication.

 

Statement of Purpose

STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the dedication of a perpetual easement for trail and street purposes across city-owned property at Brighton Beach in the Lester Park neighborhood.  The dedication of this easement will allow for extension of the Lakewalk trail through Brighton Beach this summer, the eventual relocation of the Brighton Beach Road away from the shoreline, and continued public use of the entire area as a park. An aerial view of Brighton Beach is depicted on the attached Exhibit D, with the proposed easement area shown in green and the trail alignment shown in purple. It is not necessary to dedicate an easement in those significant portions of the park where there is already a platted right-of-way.
