RESOLUTION AUTHORIZING WORK ORDER 5 TO THE MASTER PARTERNSIP AGREEMENT WITH MNDOT TO REIMBURSE THE CITY OF DULUTH TO PROVIDE PROJECT MANAGEMENT FOR THE DESIGN OF STORM SEWER OUTFALL IMPROVEMENTS INTO LAKE SUPERIOR AT SECOND, THIRD AND FOURTH AVENUES EAST, UP TO $200,782.

CITY PROPOSAL:
RESOLVED, that the proper city officials are hereby authorized to execute Work Order 5 substantially in the form attached as “Exhibit A” with the Minnesota Department of Transportation to manage the design phase of the storm sewer outfall improvement project. MnDOT will reimburse the city for all costs and fees associated with this phase, not to exceed $200,782.
Statement of Purpose
STATEMENT OF PURPOSE: The storm sewer outfall improvements will reduce the risk of debris and rock being deposited into the storm sewer pipes from windstorms and the resultant wave action. This deposition reduces capacity of the storm sewer system serving the I-35 freeway tunnels and the upgradient city system, which results in flooding of the roadway and creates a public safety issue.
In accordance with the State of Minnesota and the City of Duluth master partnership agreement, MnDOT Contract No. 1028597, each individual project is covered by a work order which defines the work and which party performs the work and the amount to be paid by each party.
This resolution, and corresponding work order, will cover this phase of the project that will include hiring TRC and AMI engineering firms (under a separate resolution) to undertake the necessary work to provide a final design plan for storm sewer outfall improvements at Lake Superior, and includes design services to aid in the bidding phase, but not to include the construction phase. The city is involved in this project due to the outfalls being directly adjacent to and passing under the city’s Lakewalk, and to the impacts to the local storm sewer system.
