RESOLUTION ESTABLISHING ELMER WAY AS THE NAME FOR THE CITY STREET LOCATED WEST OF DECKER ROAD.

CITY PROPOSAL:
RESOLVED, that in accordance with the provisions of Section 50-33.6 of the Duluth City Code, 1959, as amended, that road located in the easement recorded as document no. 956355 in the office of the St. Louis County, Minnesota Recorder generally located between Decker Road and a point approximately 688 feet to the west thereof is hereby named and designated as “Elmer Way.”
Statement of Purpose
STATEMENT OF PURPOSE: This resolution provides a name to the newly accepted public street as outlined in the report to council and by the resolution accepting the road, both of which are on this agenda. The report notifies the council that the city engineer has adopted improvements initially installed privately by a developer and are now considered public. This occurs from time to time when a private developer constructs improvements to city standards, and upon completion and acceptance of those improvements, the city takes ownership of the public improvements. In this case, the road and public utilities have been in existence for many years and have served the Schneiderman’s store. The option to become a public road was anticipated at the time, and until the city accepted the easement and took ownership of the road it had been a private, unnamed road installed to serve the new store. With the development of the neighboring property, the need for a public road has been requested from both adjacent property owners. This name designation will not require a change of address for the Schneiderman’s store. A location map is attached.
