AN ORDINANCE DEDICATING REAL PROPERTY AS PARK PROPERTY.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That the city of Duluth does hereby dedicate the real property legally described on the attached Exhibit A, Exhibit B, and Exhibit C as park property.
Section 2. That the proper city officials are authorized to record, with the register of deeds and/or the registrar of titles of Saint Louis County, Minnesota, a certified copy of this ordinance showing the property dedicated as park property.
Section 3. That this ordinance shall take effect 30 days after its passage and publication.

Statement of Purpose
STATEMENT OF PURPOSE: The purpose of this ordinance is to authorize the dedication of certain real property as park property, which shall be added to and included within the boundary of Hartley Park. A map depicting the existing boundary of Hartley Park and the property to be dedicated in this ordinance is attached as Exhibit D.

The City purchased the property legally described on the attached Exhibit A from Independent School District No. 709 in 2018 with the intention of adding the property to the boundary of Hartley Park. The purchase was funded through a grant from the state of Minnesota, Commissioner of Natural Resources. Since acquisition, the City has and continues to restore the property to protect a cold water trout stream, preserve recreational connectivity to Hartley Park from the Pleasantville neighborhood, and preserve a buffer between future development and Hartley Nature Center's primary programming area.

The City recently accepted the donation of the property legally described on the attached Exhibit B from Hartley Nature Center Corporation with the intention of adding the property to the boundary of Hartley Park. In addition, the donation was contingent upon the City's express dedication of the land as park property, as well as inclusion into the Duluth Natural Areas Program.
