ORDINANCE AMENDING SECTION 21-1 OF THE DULUTH CITY CODE TO ADOPT AND INCORPORATE THE 2020 AMENDMENTS TO THE MINNESOTA STATE FIRE CODE.

CITY PROPOSAL:
The city of Duluth does ordain:
Section 1. That Section 21-1 of the Duluth City Code is hereby amended to read as follows:
Sec. 21-1. Adoption of the Minnesota State Fire Code
The city hereby adopts by reference and incorporates into this Code the Minnesota State Fire Code set forth in Minnesota Rules, Chapter 7511, which is based on the 2018 2012 edition of the International Fire Code, and as said rules and code may be, by the state, amended from time to time, or replaced.
(a) The city adopts by reference the following appendices to said International Fire Code, their successors and amendments:
(1) Appendix B - fire flow requirements for buildings;
(2) Appendix C - fire hydrant location and distribution;
(3) Appendix D - fire apparatus access roads;
(4) Appendix E - hazard categories;
(5) Appendix H - hazardous materials management plan (HMMP) and hazardous materials inventory statement (HMIS) instructions;
(6) Appendix I - fire protection systems - noncompliant conditions;
(7) Appendix K - fires or barbecues on balconies or patios (as amended by Minnesota Rules, 7511, subpart 2);
(8) Appendix L - (as amended by Minnesota Rules, 7511.7900, subpart 5).
(9) Appendix M- high-rise buildings- retroactive automatic sprinkler Requirement
(10) Appendix N- indoor trade shows and exhibitions
(11) Appendix O- fires or barbeques on balconies or patios
(12) Appendix P- emergency responder radio coverage
(b) Appendix B, Section 105.1, of the 2012 International Fire Code is not adopted and is not a part of the Duluth city ordinance.

Section 2. That this ordinance shall take effect 30 days after its passage and publication.
