AN ORDINANCE AUTHORIZING THE CONVEYANCE OF A PERMANENT EASEMENT TO THE STATE OF MINNESOTA FOR HIGHWAY RIGHT OF WAY PURPOSES, TOGETHER WITH A TEMPORARY EASEMENT FOR HIGHWAY PURPOSES, OVER REAL PROPERTY IN LINCOLN PARK FOR $163,550.00.

CITY PROPOSAL:
The city of Duluth does ordain:

Section 1. That the proper city officials are hereby authorized to convey a permanent easement to the State of Minnesota for highway right of way purposes, together with a temporary easement for highway purposes, over the real property legally described on the easement agreement, substantially in the form attached as Exhibit A, and execute all other documents necessary to effectuate the conveyance of the permanent highway right of way easement and temporary highway easement, including but not limited to the offer for sale and memorandum of conditions substantially the same as that on file with the office of the City Clerk, for $163,550.00; funds to be deposited into Fund 110-700-1420-4640 (General Fund, Other Functions & Transfers, Capital, Sale of Land).

Section 2. That this ordinance shall take effect 30 days after its passage and publication.

Statement of Purpose
STATEMENT OF PURPOSE: This ordinance authorizes the conveyance of a permanent easement to the State of Minnesota (the "State") for highway right of way purposes, together with a temporary highway easement, over property in Lincoln Park around the intersection of I-35 and I-535. The terms and conditions regarding the grant and payment of the easements are contained in the Offer to Sell and Memorandum of Conditions attached as Exhibit B.

The State needs the easements for the Minnesota Department of Transportation's upcoming Twin Ports Interchange project. The easements will permit the State to construct, operate, and maintain infrastructure that will contain, drain, and direct the outflow of Miller Creek and Coffee Creek in association with the highway project.
