CITY PROPOSAL:

RESOLVED, that the proper city officials are hereby authorized to execute an agreement with Wisconsin Central Ltd. (CN), substantially the same as the agreement attached as Exhibit 1, to use certain CN-owned property along the entrance to its Duluth Ore Dock Facility near 37th Avenue West in connection with the Cross City Trail for $1,000.00, payable from Fund 450-030-5530-CP450-CCITY-0595TR (Capital Improvement Fund, Finance, Improvements Other Than Buildings, Cross City Trail Phase II).

 

Statement of Purpose

STATEMENT OF PURPOSE: This resolution authorizes an agreement with Wisconsin Central Ltd. (CN) for a license to use certain CN-owned property along the entrance to its Duluth Ore Dock Facility near 37th Avenue West in connection with the Cross City Trail for $1,000.00.  The $1,000 fee is a one-time payment for a license preparation fee; there shall be no annual fee thereafter. 

 

This agreement allows the city to construct and maintain the Cross City Trail from the pedestrian overpass on I-35 to approximately 37th Avenue West and Oneota Street.  The City has a separate agreement with CN to use its property near 33rd Avenue West for the same purpose, but with different requirements since there is an active, overhead track in that vicinity.  The trail segment authorized under this agreement is not near active track, but instead near an access road with vehicular traffic only.

 

Under the terms of the agreement, the City shall maintain continuously fencing no less than 6’ in height along the segment on CN’s property, as well as maintain the trail itself, which duties include removal of snow, ice, weeds, brush and other vegetation.
